The Council controls 9 car parks which have achieved the Park Mark status. This is a national scheme funded by the Police. The scheme awards the Park Mark status to car parks which have met the necessary criteria for a safe environment in which to park. From 31st March 2008, the Council adopted Civil Parking Enforcement powers for the enforcement of parking restrictions under the Traffic Management Act 2004 within the borough.

Illegal or dangerous parking can cause serious problems for all road users, including pedestrians, and by enforcing parking regulations by adopting Civil Enforcement powers, the Council aims to:

  • Manage the traffic network to ensure free movement of traffic, including pedestrians and cyclists.
  • Improve road safety.
  • Improve the local environment.
  • Improve the quality and accessibility of public transport.
  • Meet the needs of people with disabilities, some of whom will be unable to use public transport and depend entirely on the use of a car.
  • Manage the competing demands for kerb space of residents, businesses, visitors, pedestrians, users of public transport (including buses, taxis and coaches), car drivers, cyclists and motor cyclists.

There are some changes to the previous parking regulations. The legislation has not been introduced as a means of generating income. However, illegal parking activities will still be subject to penalty charges.

Rotherham MBC wishes to inform drivers in the borough of the new contraventions and the changes to the penalty charges.

Parking contravention charges will be divided into two categories.

There will be a lower category charge of £50, discounted to £25 if paid within 14 days. This charge will be for less serious offences such as over staying in an off street car park.

For more serious contraventions, such as parking on double yellow lines, there will be a higher category charge of £70, discounted to £35 if paid within 14 days.

New Contraventions

The introduction of new contraventions will mean that Penalty Charge Notices can be issued for contraventions such as parking on zig-zag lines at pedestrian crossings, adjacent to dropped kerbs and to vehicles parked more than 50cm from the kerb.

Presentational Changes

From 31st March 2008 our Parking Attendants will be known as Civil Enforcement Officers. They will still wear the same coloured uniforms and work in the same areas of the borough.

Civil Enforcement Officers

The Civil Enforcement Officers are the public face of the Council’s Civil Parking Enforcement and the way they perform their duties is crucial to the success and public perception of our enforcement operation. The Officers are trained to be professional and efficient at all times, sometimes in difficult circumstances. It is the Council’s aim for them to be regarded in this way by the public. They have qualities of firmness, sensitivity and tact along with common sense and patience.
As well as undertaking enforcement duties, our Civil Enforcement Officers should provide assistance, when asked, to motorists requiring information about the availability of parking spaces and the cost of parking.

Penalty Charge Notices issued by post

In a situation where a Civil Enforcement Officer has started to issue a Penalty Charge Notice but is then prevented from completing the issuing procedure by the driver or the vehicle being driven away, the Council will be able to issue the Penalty Charge Notice by post to the keeper of the vehicle.

CCTV Enforcement of Parking Contraventions

The Council will be able to use CCTV cameras (approved devices) to collect evidence of parking contraventions and will then be able to issue Penalty Charge Notices by post. Drivers are therefore advised to park legally at all times, as illegal parking may result in the issue of a Penalty Charge Notice by post.

Appeals Procedure

A recipient of a Penalty Charge Notice will be able to make an initial informal challenge followed by a formal representation if he / she is not satisfied with the initial response. A final appeal to the independent Traffic Tribunal is the next course of action if the response is not satisfactory.

The police will still issue Fixed Penalty Notices for issues such as obstructive parking and moving traffic offences which can result in penalty points on a driving licence.
